We believe consumers need to be informed and protect themselves when hiring a home care

services provider. This is now easily done by consumers being equipped to get the appropriate

documentation and paperwork that will protect them from unwanted financial liability and potential

legal difficulties.

We strongly suggest that every consumers downloads and uses a copy of the Home Care Service

Consumer Disclosure Statement. For any home care provider that they interview for service, even

Private Caregivers, have them complete and sign this document. If they are reluctant to sign or

complete the form then we suggest that you seriously reconsider having that business or person

provide care services.

The Home Care Service Consumer Disclosure Statement will detail what we believe is vitally

important information for consumers to know, such as:

·    If the home care company is an employer, a registry, some other non-employer or Private Caregiver?

·    The responsibility the company or Private Caregiver will assume (if any) for the payment and filing applicable reports and forms for caregivers or the Private Caregiver's?

·    Who actually pays the caregiver or Private Caregiver their Wages?

·    Who pays and files the forms for the Payroll Taxes, including Social Security and Medicare  taxes for caregivers or the Private Caregiver?

·    Are there any Overtime Wages, and if so when and what are they?

·    Who pays for Workers’ Compensation Insurance for caregivers or Private Caregiver?

·    Who pays for the caregivers’ or Private Caregivers’ Liability Insurance and State and Federal Unemployment Compensation liabilities?

After the home care business provider representative or Private Caregiver has completed and signed the Home Care Service Consumer Disclosure Statement, consumers can review how the provider answered the questions and better determine and assess if they are comfortable with that particular business service provider or Private Caregiver.
